Industrial manslaughter developments; reminder on WHS consultation

Recruitment leaders don't have much reason to fear expanding industrial manslaughter laws, but they are a timely reminder to comply with duties to consult with clients about work health and safety, a lawyer says.

Safety Ministers recently voted to incorporate manslaughter provisions into national model WHS laws, and the provisions address concerns raised in a 2018 review of the legislation, Squire Patton Boggs director Steve Bowler tells Shortlist.

It's not a radical change, he says. Various states and territories already had industrial manslaughter as an offence under their WHS legislation, but it does open the door for states that don't currently have these provisions (NSW, SA and Tasmania) to adopt the model framework...
