On-hire worker wins compensation after redundancy consultation failure

The Fair Work Commission has ordered WorkPac to compensate an on-hire worker who was retrenched without proper consultation, though the amount falls far short of what he was seeking.

Commissioner Bernie Riordan found in March last year that WorkPac had failed to consult with and redeploy five workers during a redundancy process, initiated after mining client South 32 suffered a downturn in work.

Finding this meant they weren't genuine redundancies and there was no valid reason to sack the workers, Commissioner Riordan concluded their dismissals were harsh and unfair...
