Anti-vax candidate had false expectation of "personal service"

Hays has fended off an unfair dismissal claim from an on-hire worker who refused to comply with a host employer's vaccination policy.

Hays had placed the casual worker with Westpac in July 2021. In October, Westpac advised that it intended to require all office-based workers to be vaccinated, taking effect from February 2022.

The worker acknowledged receipt of the advice and indicated she was not going to become vaccinated, therefore she wouldn't be able to continue working with Westpac beyond the end of her contract in January.

In December, she emailed Hays about her contract ending and said she would like a further assignment – preferably permanent, though she would accept contract work...
