Court restrains manager accused of poaching "sizeable number" of clients

An organisation has won an injunction upholding a former employee's restraints, after telling a court it has already lost 21 clients to his new employer.

Though not involving a recruitment company, the case provides a useful reminder of the factors courts consider when determining whether to grant injunctions.

AEI Insurance Group is suing the former account manager for allegedly breaching his employment contract, and applied to the Federal Court for interlocutory relief.

The employer claimed that the employee resigned in August this year; he initially refused to indicate where he was going, but eventually admitted he would be working for a competitor, MA Insurance Brokers...
