Failed injunction bid sends warning on overly restrictive restraints

Employers must beware adopting a "blanket approach" to post-employment restraints, a lawyer has stressed in the wake of a failed injunction application.

The case didn't involve a recruitment company, but nonetheless highlights the principles a court will rely on in deciding whether restraints are enforceable.

In December last year, the United Petroleum wholesale state manager resigned so he could take up an aviation sales manager position with IOR Services, which also operates in the petroleum products sector.

United Petroleum subsequently claimed this would breach the restraints in his employment contract, and applied for interim relief enforcing the terms...
