Federal Court approves amendments to Hays class action

The Federal Court has allowed an employee to amend his underpayments class action against Hays, finding it was "abundantly clear" some aspects were bound to fail.

In December 2018, Lawrence Ridge began a class action on behalf of himself and all coalmining workers employed by Hays between December 2012 and December 2018, who worked according to a regular roster and who were treated as "casual" employees.

He claimed group members: had been underpaid 'loaded rates' for overtime and shift, weekend and public holiday work; were entitled to annual leave; and weren't "casuals" and therefore Hays hadn't paid their entitlements under the National Employment Standards...
