Job offer rescinded after 'pay secrecy' enquiry

A candidate who accused an employer of offering him a lower salary based on his skin colour has been blocked from pursuing a general protections claim, after the Fair Work Commission found he wasn't 'dismissed' when his job offer was revoked.

The candidate made a general protections claim involving dismissal, but Hi-Reach Rentals objected on the basis he never became an employee.

The Commission heard that on 13 October last year, the employer offered the candidate an accounts receivable position, with a $75k salary, to start on 23 October.

The candidate accepted the offer, and the employer's administration manager emailed him some onboarding information...
