LinkedIn posts fuelling restraints litigation

A LinkedIn post about starting a new role can constitute a breach of post-employment obligations that, as the market tightens, recruitment agencies are increasingly willing to enforce, a lawyer warns.

Before social media, it might have been difficult to get evidence of somebody breaching their restraints, but activity on platforms like LinkedIn is hard to hide, Squire Patton Boggs partner Nicola Martin tells Shortlist.

Particularly when a recruiter is setting up their own agency, and is promoting their services on LinkedIn – where many of their contacts and connections are either candidates or clients of their former employer – a mere announcement can constitute a non-solicitation breach, she says...
