On-hire worker granted extra time to claim unfair dismissal

A labour hire company has failed to block an out-of-time unfair dismissal claim, after the Fair Work Commission found it had ignored a worker's numerous attempts to clarify his employment status.

Synaco Global Recruitment denied dismissing the employee, who it had hired on a "casual, hourly, and as needed basis", noting he was still a registered candidate.

It said the employee's last assignment ended in February this year due to a downturn of work with the host employer, Monroe Springs.

Regardless, the employee's unfair dismissal claim was made 37 days outside the 21-day time limit and therefore couldn't proceed, it argued...
