Recruiter loses dispute over unpaid payroll tax penalty

Disruption caused by the pandemic and serious illness to family members don't excuse late payment of payroll tax, the NSW Civil and Administrative Tribunal has ruled in a case involving a recruitment company.

IT specialist Continuum Recruitment was appealing the NSW Chief Commissioner of State Revenue's decision to levy penalty tax on the company, after it was late remitting tax during 2022 and early 2023.

Penalty tax was imposed in respect of the tax unpaid for FY22 ($29,779.44) in the amount of $7,444.86. When Continuum's payroll tax continued to go unpaid, the Chief Commissioner levied further penalties, culminating in a $45,885.49 penalty in April 2023...
