An employer has failed to prove a recruitment company didn't exercise due skill and care in delivering its services, but has nonetheless won a partial refund of a placement fee due to the contract being frustrated.
VCAT Member Neill Campbell dismissed an application by MKIH Pty Ltd, which trades as the Kings Creek Hotel, for compensation or damages as a result of a January 2020 contract with Hospoworld Resourcing.
