Removing recruitment duties didn't force manager to resign

The former manager of a recruitment team has failed to prove she was constructively dismissed after she complained about her workload.

In September last year, Valley Healthcare Group told the HR manager that she wouldn't be involved in any further recruitment activity for a related business, South Coast Facility Services. Both companies are led by Health Staffing Australia MD and RCSA non-executive director Ross Thompson.

The HR manager subsequently emailed Thompson, complaining that his decision to "take away" her management of the recruitment team was "unjust and unfair".

She said she had no issues managing her team or workload, but had simply stated that she was "very busy" and had "a lot on [her] plate each week" compared to other managers...
