'Underpaid' worker was a contractor, not employee

In a new contractor-versus-employee ruling, a worker has unsuccessfully tried to claim he was sacked for complaining about his pay.

Federal Circuit Court Judge Robert Cameron dismissed the vocational trainer's case, finding he had not demonstrated that he had been employed by Global Business College of Australia (GBCA), "rather than retained as a contractor".

The worker had entered into a contract with GBCA in 2016, as a sessional trainer delivering classes to students and assessing their work during semesters.

In December 2020, GBCA informed him that his pay was to be reduced from $60 to $45 per hour and he would no longer be paid for marking and assessing students...
