Withdrawn job offer was a dismissal: FWC

A candidate who had been offered a role but refused to attend an unpaid training session has been cleared to pursue a general protections claim, after the Fair Work Commission found she had been "dismissed" despite never starting work.

Deputy President Thomas Roberts found several factors indicated City Perfume Retail and the candidate were in an employment relationship, "albeit one of relatively short duration", at the time of her dismissal.

In April this year, the employer's HR manager wrote to the candidate to congratulate her on successfully interviewing for a fragrance brand ambassador position, and to say onboarding information would be forthcoming...
